Welcome to FLCN. This document constitutes an electronic record in accordance with the Information
Technology Act, 2000 and the applicable rules framed thereunder. This electronic record is generated by a
computer system and does not require any physical or digital signatures.
These Terms of Use govern your access to and use of the FLCN website and all associated digital platforms
and other communications, including any content, features, services, and tools made available thereon
(collectively, the "Platform"). The Platform is owned, operated, managed, and marketed by Starr Enterprises
(referred to as "FLCN", "Company", "We", "Us", or "Our").
For the purposes of these Terms, the expressions "You", "Your", or "User" shall mean any natural person or
legal entity who accesses, browses, registers on, purchases from, or otherwise uses the Platform in any
manner. Where the User is a minor or otherwise not competent to contract under applicable law, such use shall
be deemed to be through a parent, guardian, or other person legally competent to contract, who shall be bound
by these Terms on behalf of such User.
By accessing, browsing, registering on, purchasing, or using the Platform, you acknowledge that you have read,
understood, and agreed to be bound by these Terms of Use, together with all other policies published on the
Platform from time to time, including the Privacy Policy and the Return and Exchange Policy. Your usage and
acknowledgment of these terms constitute a legally binding agreement between you and FLCN.
FLCN reserves the right, at its sole discretion, to amend, modify, update, replace, or remove any part of these
Terms or any policy incorporated herein, at any time. It is your responsibility to review these Terms periodically.
Your continued use of the Platform following any modifications (change) shall constitute your acceptance of the
revised Terms. If you do not agree with these Terms, you must refrain from accessing or using the Platform.
1. Acceptance of Terms
These Terms and Conditions, along with our other policies, apply to all platforms owned, operated, managed, or
marketed by Starr Enterprises under the brand FLCN, including the website and any affiliated digital or social
media platforms. We are committed to protecting the privacy, confidentiality, and security of all personal and
financial information shared by users, and to processing such information in compliance with applicable laws.
2. Eligibility and User Assurances
By accessing, registering on, or using the Platform, you represent and warrant that you are competent to enter
into a legally binding agreement under applicable law. If you are under 18 years of age, you may use the
Platform only under the supervision and consent of a parent or lawful guardian who agrees to be bound by these
Terms on your behalf.
You further represent that all information provided by you is true, accurate, complete, current, and not
misleading. You agree to promptly update your account information to keep it accurate. FLCN shall not be liable
for any loss arising from false or incomplete information, and reserves the right to suspend or terminate access
where it reasonably believes any information provided is untrue, inaccurate, or in breach of these Terms in any
manner whatsoever.
3. Nature of the Platform
Starr Enterprises operates an online commerce platform that enables users to browse, select, and purchase
apparel, accessories, and related lifestyle products made available on the Platform from time to time. FLCN
reserves the right, at its sole discretion and without prior notice, to introduce, modify, withdraw, suspend, or
discontinue any part of the Platform, including product listings, features, or promotional offers. The availability of
any product or feature at a given time creates no obligation to continue making it available in future.
4. Account Registration and Security
Certain features may require you to create an account. You are responsible for safeguarding your username,
password, OTP, and any linked device credentials. All actions carried out through your account are deemed to
be authorised by you unless you notify us promptly of unauthorised activity. We may suspend or terminate
access where we reasonably suspect misuse, fraud, or breach of these Terms in any manner whatsoever.
5. Product Listings and Descriptions
FLCN endeavours to present all products as accurately as reasonably possible. However, actual colours,
texture, finish, dimensions, and fit may vary due to device display settings, screen resolution, lighting,
photographic limitations, and inherent material variations. All product images and styling visuals are for
illustrative purposes only, and minor variations shall not be construed as defects or misrepresentation. All
products are subject to availability and stock limitations.
6. Pricing and Charges
All prices are displayed in Indian Rupees unless stated otherwise. Applicable taxes, delivery charges, COD
charges, or promotional deductions will be reflected at checkout. We reserve the right to correct typographical or
system errors affecting price or description and may cancel orders impacted by such errors. If payment has
already been collected for a cancelled order, the amount will be refunded in accordance with our refund process.
7. Order Placement and Acceptance
Placing an order constitutes an offer by you to purchase products from FLCN. Order acknowledgement, invoice
generation, or status updates do not by themselves amount to final acceptance. We reserve the right to accept,
decline, or cancel an order for reasons including stock unavailability, suspected fraud, unusual order patterns,
delivery limitations, pricing errors, or inability to verify payment or identity.
8. Payments
Payments may be processed through banks, payment gateways, UPI providers, wallets, cards, net banking,
cash-on-delivery arrangements, or other authorised channels made available on the Platform. Your transaction
may additionally be governed by the terms of the relevant payment service provider. FLCN is not responsible for
failure of payment caused by your bank, processor, network issues, timeouts, insufficient balance, or third-party
system interruption.
9. Delivery and Fulfilment
Orders are dispatched within 2 to 3 business days and typically delivered within 5 to 8 business days, subject to
pin code serviceability. Delivery timelines are indicative and may vary based on courier operations, weather,
public holidays, force majeure events, or verification delays. We currently ship within India only. You are
responsible for providing a complete and accurate delivery address and being available to receive the shipment.
Risk in the product shall ordinarily pass upon delivery at the designated address, subject to applicable consumer
law.
10. Returns, Exchanges, Cancellations, and Refunds
Returns
Return requests may be initiated through the FLCN website within 14 days from the date of delivery. To be
eligible for return, items must be unused, unwashed, undamaged, and in intact condition, with all tags and
original packaging. We reserve the right to decline returns if items appear used, washed, damaged, or spoiled,
unless they arrived in that condition. Products purchased under special promotional offers may not be eligible
for return.
Exchanges
Exchange requests may be initiated through the FLCN website within 14 days from the date of delivery, subject
to the same condition requirements as returns. The replacement item shall not be dispatched at the time of
return pickup. Upon successful pickup of the original item, typically within 2 to 3 business days, the exchange
item shall be shipped in accordance with standard delivery timelines.
Free Gifts on Qualifying Orders
If your order came with a free gift and your return or exchange brings the order below the gift's qualifying value,
we would love for you to send the gift back too, unused and in original condition. If you would rather keep it, no
worries, its value will simply be adjusted against your refund. If you are only returning part of your order and still
stay above the threshold, the gift is yours to keep.
Defective or Incorrect Products
If you have received a defective or incorrect item, please share an unboxing video and photos through the
Contact Us form on our website, and our Customer Experience Team will assist you.
Order Cancellation
Cancellations are only possible if and until the order has not been dispatched from our warehouse.
Please note: Items purch ased during Sale Events or Flash Sales are final sale and cannot be returned or
exchanged.
Refunds
Shipping charges are non-refundable on COD orders. Once your return is received and inspected, approved
refunds shall ordinarily be processed to your original payment method within 5 to 7 working days. For COD
orders, refunds are issued to your provided bank account. Where a return or refund request is disputed, found to
be non-compliant, or requires additional review, FLCN reserves the right to delay, withhold, adjust, or reject the
refund in accordance with its policies and applicable law.
11. Promotions and Coupons
All discount codes, coupons, referral benefits, wallet credits, store credits, and similar promotional benefits are
subject to the specific terms applicable to the relevant campaign. FLCN reserves the right to modify, suspend,
withdraw, or restrict such benefits where misuse, duplication, technical glitches, fraud, or breach of offer
conditions is identified or reasonably suspected, subject to applicable law.
12. Acceptable Use
You agree not to use the Platform for unlawful, abusive, fraudulent, defamatory, harmful, or disruptive conduct.
Without limitation, you must not introduce malware, use bots or scrapers without permission, place fake orders,
interfere with the Platform's security or functionality, manipulate reviews, infringe third-party rights, or attempt to
reverse engineer the Platform except as expressly permitted by law.
13. Reviews, Feedback, and User Submissions
If you submit any feedback, reviews, ratings, photographs, videos, or other content on or through the Platform
("User Content"), you represent that you own or have all necessary rights to submit it, that it does not infringe
any third-party right, and that it does not violate any applicable law. By submitting User Content, you grant Starr
Enterprises a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable licence to use,
reproduce, adapt, publish, display, and distribute such content for operating, marketing, and promoting its
business and the Platform, subject to applicable law. FLCN reserves the right to review, refuse, moderate, or
remove any User Content at any time.
14. Intellectual Property
All material on the Platform, including trademarks, logos, trade names, software, layouts, product photography,
graphics, videos, and written content, is owned by or licensed to Starr Enterprises and remains protected under
applicable intellectual property laws. No right or licence is granted to you except the limited right to use the
Platform for personal and lawful shopping purposes.
15. Third-Party Services and Links
The Platform may integrate with or contain links to third-party websites, gateways, logistics providers, or
embedded services. FLCN does not control those services and is not responsible for their content, security,
policies, or performance. Where purchases are made through third-party marketplaces, the terms and policies of
such marketplace shall apply, and FLCN shall not be held responsible for any act, omission, or service matter
arising therefrom.
16. Disclaimer of Warranties
To the extent permitted by law, the Platform and all related services are provided on an "as is" and "as available"
basis. We do not guarantee uninterrupted operation, complete accuracy of all content at all times, or that the
Platform will always be free from bugs, vulnerabilities, or service interruptions. Nothing in these Terms excludes
rights or remedies that cannot lawfully be excluded.
17. Limitation of Liability
FLCN shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss
of profits, revenue, data, goodwill, or business opportunity, arising from or in connection with your use of,
inability to use, or reliance upon the Platform, products, or services. FLCN's total liability for any claim arising in
connection with a product or order shall not exceed the amount actually paid by you for that product or order.
FLCN shall not be responsible for disputes arising solely between users or with third parties.
18. Indemnity
You agree to indemnify, defend, and hold harmless Starr Enterprises, its affiliates, partners, employees, agents,
and representatives from and against any claims, losses, liabilities, damages, costs, and expenses, including
reasonable legal fees, arising out of your use or misuse of the Platform, breach of these Terms, violation of
applicable law, or infringement of any third-party rights. This indemnity shall survive the termination of your
account and your use of the Platform.
19. Suspension and Termination
FLCN may, at its sole and reasonable discretion, suspend, restrict, or terminate your account or access to the
Platform, with or without prior notice, if it believes you have breached these Terms, engaged in fraud, misuse, or
suspicious activity, created risk to the Platform or other users, or where such action is required for legal,
security, technical, operational, or any other reasons. To maintain a secure experience, FLCN may monitor
account and transaction activity and take appropriate action where irregular or abusive patterns are detected,
20. Force Majeure
FLCN shall not be liable for any delay, interruption, or failure in performing its obligations where such failure
arises from any cause beyond its reasonable control, including acts of God, natural calamities, floods, fires,
epidemics, pandemics, strikes, governmental actions, judicial or regulatory orders, failure of internet or
telecommunication services, cyber incidents, power outages, supply chain disruptions, war, civil unrest, or
failure of courier or logistics networks. During any such event, FLCN's obligations shall remain suspended for its
duration, except to the extent otherwise required under applicable law.
21. Governing Law and Jurisdiction
These Terms shall be governed by the laws of India. Subject to rights available to consumers under applicable
law, disputes shall be subject to the exclusive jurisdiction of the competent courts at Bengaluru, Karnataka.
22. Customer Support and Grievance Redressal
Users may contact our customer support team through the Contact Us form on the Platform for any complaint,
grievance, or request relating to orders, payments, refunds, returns, exchanges, account access, or use of the
Platform. FLCN shall acknowledge complaints within forty-eight (48) hours of receipt and endeavour to redress
them within a reasonable time from the date of receipt, or within such timeline as may be required under
applicable law. Where any complaint is not resolved within a reasonable time, the aggrieved user may avail
such remedies as may be available under applicable law before the competent consumer dispute redressal
forum.
23. Fraud & Scam Awareness
FLCN will never contact you to request advance payments, extra charges, or any financial transaction after your
order has been placed. Please stay cautious and do not engage with any such fraudulent calls, messages, or
phishing attempts. If you come across activity like this, we advise you to report it immediately to the National
Cyber Cell (Helpline: 1930) or file a complaint at https://cybercrime.gov.in/Webform/Helpline.aspx. Once your
complaint is registered, you can also reach out to us through the Contact Us form on our website with your
complaint reference number so we can help you further.
24. Entire Agreement and Severability
These Terms, together with the Privacy Policy and any incorporated policy documents, form the complete
agreement between you and Starr Enterprises in respect of your use of the Platform. If any provision of these
Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
